Draft for attorney review. This is not legal advice and it is not a finished contract. TailgateLog has not had this text reviewed by counsel.

The service

TailgateLog helps a company document safety meetings, sign-in, and incident reports. It does not give legal advice. It does not replace the Cal/OSHA 300 log, Form 300, Form 300A, or Form 301. It does not file the Title 8 section 342 report for a serious injury, illness, or death. A competent person still decides heat and smoke steps. Shade above 80°F, high-heat procedures at 95°F, and voluntary N95s at PM2.5 AQI 151 through 500 are the thresholds the product shows. They are not a substitute for the regulation or for that person.

The account

The person who creates the company is the first owner. You are responsible for the people you add and for the truth of what you record. Do not put a password in a shared text that you cannot revoke.

Plans

Free and Pro limits are shown on the pricing page and under Plan and billing. The dollar amounts there are placeholders until the operator confirms them. A 14-day Pro trial does not ask for a card. When a subscription is canceled, the records stay and the company moves to Free limits. Signing in to a meeting and filing an incident are not blocked at a plan limit.

If Stripe is not configured on the server, billing is not charged and companies stay on the full founder plan.

Acceptable use

Do not use TailgateLog to break the law, to store data you have no right to store, or to probe the service. Do not upload a signature or a photo of a person who did not take part, except a photo of a condition that the report describes.

Availability

The service can be down for maintenance or for a provider failure. Offline sign-in on a phone is stored on that phone until it uploads. We do not promise a particular uptime in this draft.

Warranty and liability

The service is provided as available. This draft does not create a warranty that a packet will satisfy an inspector or that a record meets every Cal/OSHA duty. Liability terms need counsel before they are relied on. Do not treat this paragraph as a limitation of liability clause.
